Terms and Conditions: Incitec Pivot Fertilisers EASY N Online Competitions
The Incitec Pivot Fertilisers EASY N Online competition is being held and promoted by Incitec Pivot Fertilisers (IPF), a business of Incitec Pivot Limited ABN 42 004 080 264.
Eligibility
- Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
- Entry is open to those persons that reside in the following states: New South Wales, Victoria, Queensland, South Australia and Tasmania. This also includes people who register their details on the EASY N website. This is also including the list of people who have re-registered their details in the 2011 season.
The Draw
- Entry to the competition opens on 11/8/11 and concludes on 13/10/11 (Draw Period). The draw will be conducted by random selection of valid entries .The winner will be selected by random computer selection when registering the site.
- Each valid entry that is entered during the Draw Period will be entered into the draw. One valid entrant will be drawn at random from all entries to become the winner. The draw to determine the winner will take place at 12:00pm at the offices of Incitec Pivot Limited, 28 Freshwater Place, Southbank, Victoria.
- Any entry that is deemed incomplete or incomprehensible by IPF will be considered invalid. Any entry that is entered outside of the Draw Period will be invalid. Any entrant that is an individual must be 18 years or over.
- The winners will be notified in writing within five days of the draw.
- The names of the winners will be published in [The Australian] on Saturday the 22nd of October
- If a winner is a body corporate or partnership (or otherwise not a natural person), the winner must nominate a person to use the prize. The winner may nominate such a person on the entry form for the draw or otherwise by notice in writing to IPF no later than 5 working days from the draw (such person being a Nominee). A Nominee must be over 18 years of age.
- IPF reserves the right, at its discretion, to require winners to provide proof of the validity of entry, identity, age, address and other contact details of it or its Nominee in order to claim the prize. If the winner cannot comply with IPF’s requirements, the winner will forfeit the prize in entirety and no substitute will be offered. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the draw and all entries of an deemed by IPF to have provided incorrect, misleading or fraudulent information may, at the discretion of the IPF, be deemed invalid.
The Prize
- There is one prize to be won. The winner will receive:
- a return economy airfare for two people from the [capital city in the state in which the winner [or its Nominee] normally resides] to Melbourne. If the winner [or their Nominee] normally resides in Victoria, these airfares will not be part of the prize;
- two nights accommodation for two people at the Mantra on Southbank.
- tickets for two adults to attend the 2011 Melbourne Cup Carnival Winning Post On Ground Marquee on Emirates Melbourne Cup Day, Tuesday 1 November 2011 at an Winning Post Marquee (valued at $950 per person).
- The winner [or the Nominee] is responsible for ensuring they attend the relevant airport in time to check-in to the relevant flight. The winner [or the Nominee] will bear any costs associated with travelling to the relevant airport in order to meet the flight to Melbourne. The winner [or the Nominee] will bear any costs associated with travelling from Melbourne to their home destination.
- The winner [or the Nominee] will be responsible for all other expenses including but not limited to spending money, food and drinks that are not provided in the Elevated Marquee, taxis, transfers, hotel services (including but not limited to mini-bar costs and other hotel costs and fees associated with goods and services provided at the hotel) other than accommodation specified above, travel to and from the hotel to the event, travel insurance, activities, incidentals and all other ancillary costs. No spending money is included in the prize.
- The total value of each prize is $3000.IPF will not be responsible for any variation in value of the prize. The value of the prize is based on the recommended retail price at the time the prize was acquired by IPF.
- Should any prizes remain unclaimed (after IPF makes reasonable attempts to contact the winning entrant shortly after the draw) or an entrant is unable to satisfy these terms and conditions or in any way forfeits or does not claim the prize, IPF reserves the right to conduct a re-draw.
- Any part of the prize that the winner [or its Nominee] does not use will be forfeited with no substitutions offered. The prize cannot be transferred, exchanged, redeemed for cash or other goods or services.
- If any aspect of the prize cannot be provided to the winner [or its Nominee] for any reason, IPF reserves the right to substitute to the winner a prize of equal or greater value (subject to law).
None of the times or dates set out in this clause can be changed.
General
- IPF makes no representations as to the safety conditions that may exist at the destination or at the event.
- IPF may ask winners to participate in a promotion related to the draw, which may include taking the winner’s photograph. The winner agrees to participate in such promotion and is not entitled to any fee for their participation.
- The winner [and/ or its Nominee] should seek independent financial advice as there may be tax implications in accepting a prize.
- IPF’s decisions are final and IPF will not enter into correspondence relating to the competition result.
- IPF reserves the right to disqualify any entrant who IPF has reason to believe that it [(or its representatives or Nominee)] has breached any of these terms and conditions or engaged in any unlawful or other improper conduct calculated to prevent the fair and proper conduct of the draw in its sole discretion.
- IPF may, in its absolute discretion, cancel the competition where an event prevents IPF from proceeding with the competition on the dates and in the manner described in the terms and conditions, for example events such as (but not limited to) vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism.
- Except for any liability that cannot be excluded by law, IPF (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage whatsoever (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion or the draw, including, but not limited to, where arising out of the following: (a) any unauthorised access to, or alteration of, entries; (b) any third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of IPF; (d) any variation in prize value to that stated in these terms and conditions; or (f) use of/ participation in a prize.
- As a condition of accepting the prize, the winner [(and/ or its Nominee)] must sign any legal documentation as and in the form required by IPF in their absolute discretion, including but not limited to a legal release and indemnity form.
- [If clause [#] applies, a winner must ensure that its Nominee complies with these terms and conditions. A winner shall ensure that its Nominee shall not take any action (in contract, tort or otherwise) in respect of any claim for loss or damage whatsoever made by the Nominee against IPF or any of its related bodies corporate (or any of their respective officers, employees or agents), arising in any way out of, or in relation to, the promotion, the draw or a prize and indemnifies IPF and its related bodies corporate (and each of their respective officers, employees or agents) in respect of any and all losses, expenses, damages and costs incurred in respect of such a claim by a Nominee.]
